Terms and Conditions
Live, Online, Onsite In-Person, and Simulcast Auctions
Buyer's Premium: 10% Colorado Sales Tax: 5.4%
Payment for online, live, and simulcast auctions is accepted as cash, credit card, or local check.
Pickup for live onsite auctions is the day of the auction, unless prior authorization has been made.
Onsite In-Person (Pickup) Live Auction Terms
VERY IMPORTANT — READ CAREFULLY BEFORE YOU BID. Once you place a bid, you are legally bound by the terms and rules stated here. Registering for our auctions constitutes a contract, and the following terms apply. Terms and conditions may change depending on the circumstances of each sale, so it is important to review them before participating in any auction.
Pickup at the Advertised Auction Location
You are required to bring help to load out your items. Our staff will guide you to where your items are located, but you are responsible for loading them yourself. If you need our assistance, prior arrangements must be made.
All bidders must pick up their items no later than 4:30 p.m. on the next business day after the auction closes; we are open only during the onsite live auction. Items left behind are subject to a $10-per-lot, per-day storage charge. Items left more than 24 hours past the pickup deadline will be forfeited, without refund. We are not responsible for damage to, or loss of, items left past the scheduled pickup time.
Pickup at Locations Other Than Woolsey Auction Company
Many of our onsite auction locations transfer to new owners the following day, so pickup times are strongly enforced. Items not removed within the posted time frame are subject to a minimum $25-per-lot moving fee; large items and furniture are subject to a minimum $50-per-lot fee. Items left more than 24 hours past pickup will be considered abandoned and forfeited, without refund. Failure to pay for or pick up items during the scheduled times will result in revocation of your bidding privileges.
Our staff will be onsite to assist with loadout and will bring items to the curb for you; loading items into your vehicle is your responsibility. Woolsey Auction Company is not responsible for safely loading items for transport, or for damage to or loss of items left past the scheduled pickup time.
Fees Charged to the Card on File
The following fees will be charged to the credit card on file when applicable:
- A $10 credit card reprocessing fee for any denied card.
- A $25 non-removal fee for any lot or partial lot left behind, plus all disposal costs.
- A $50-per-hour fee if you require our staff to stay past the designated ending time.
- Repeated tardiness and/or failure to remove items will result in revocation of bidding privileges on all of our bidding platforms.
Online Auction Terms with Simulcast bidding
Auction Closing Times and Technical Difficulties
Our online auctions close with a staggered delay between lots, rather than all at once, making it easier to bid on multiple items in the same auction. If the website malfunctions or another technical difficulty occurs, bidding for the entire auction will reopen and be reset to a later closing time. This does not apply to difficulties with your own internet connection or bidding equipment. In the event of a technical difficulty, you as the buyer agree to hold Woolsey Auction Company harmless for any resulting damages or costs.
Buyer's Premium
A buyer's premium is charged on every purchase. The buyer's premium is an advertised percentage of the high bid — or a flat fee — added to the high bid to become part of the total purchase amount at settlement. By bidding, you agree to these provisions and to pay the applicable buyer's premium.
Shipping

We are not Amazon — we do not provide free shipping. If shipping is required, a $15 packaging fee applies per box for materials and processing. We will combine lots to minimize shipping costs unless you advise us otherwise.
Oversized or especially delicate items may be taken to the local UPS Store for packaging and shipment. All actual shipping and insurance costs will be charged to the card on file. Unless you specify otherwise, items will be insured for the invoiced amount.
Helpful Terminology
Staggered Ending: Lots begin closing at the designated time, at a set rate. Watch the countdown timer on each lot (see “Auction Closing Times and Technical Difficulties” above).
Max Bid: You may place a max bid on any item, and the system will bid on your behalf up to that amount, eliminating the need to watch your bids continuously. This option is highly recommended so you don't miss an item for any reason; enter your maximum amount in the “Place Bid” box.
Force Bid: This button raises the bid to the amount you enter. It is intended for bidders who want to discourage other bidders from continuing.
Soft Close: Any bid placed in the final minutes of an auction automatically extends bidding on that lot by one minute, giving other bidders a chance to respond. If you do not use the max bid feature and are outbid, you will be notified by email or text and given the opportunity to raise your bid.
Sales Tax
Sales tax is charged and collected on all purchases, including coins, as required by applicable state and local law. If you are sales-tax exempt, you must complete and email the appropriate exemption form to [email protected]. The Colorado exemption form is available here. If you enter a tax-exemption number but we do not have the completed form on file, you will be required to pay sales tax before picking up your purchases.
Payment
By bidding with a credit card, you waive the right to dispute or deny payment for any resulting purchase. The credit card on file will be charged for your total purchases, including any buyer's premium and other applicable fees, after the auction closes. Declined transactions — due to expiration, insufficient funds, or other reasons — are subject to a $10 reprocessing fee. Credit card chargebacks are not permitted. You may update your card under “Profile” on the website dashboard, and you are responsible for keeping your card on file current.
A paid invoice will be emailed to your registered address within 12 hours of the auction's conclusion. If you do not receive one, check “Profile > Invoices” on the dashboard.
Purchases over $1,000, and titled vehicles, must be settled with cash, wire transfer, or by prior arrangement with Woolsey Auction Company. No item will be released or transferred until payment has posted to our account.
Use of Woolsey Auction Company Photos and Descriptions
All photos and descriptions on woolseyauction.com are the property of Woolsey Auction Company in Colorado. Neither Woolsey Auction Company nor its employees grant permission to use these photos or descriptions on any other site.
Bid Retractions
Woolsey Auction Company does not allow bid retractions of any kind. If you enter an incorrect max bid, we may, at our sole discretion, adjust your max bid down to the current high bid so that you remain the high bidder — but only if we determine the error to be genuine.
General Auction Terms and Conditions
Basic Terms
Woolsey Auction Company reserves the right to govern the goods and services sold to clients and to maintain the integrity of our business. We may terminate an auction at any time; withdraw any item from sale; sell items not listed; group multiple lots into a single selling lot, or subdivide a lot into two or more selling lots; and sell all listed items in bulk.
No Liability
- Woolsey Auction Company assumes no liability for your purchases. The buyer agrees to indemnify and hold the Auction Company and seller harmless from any future claim relating to the fitness or use of the purchased asset.
- Persons attending an exhibition, sale, or removal of goods assume all risk of damage or loss to person or property, and release and indemnify the Auction Company from liability. Neither the Auction Company nor its principals or the seller is liable for any defect in, or condition of, the premises where the sale is held. Any debt collection or dispute must be litigated, arbitrated, or mediated in Fremont County, Colorado.
Consignors and Bidders
- All consignors must complete a contract with Woolsey Auction Company and abide by our stated terms.
- All bidders must register for a bidder number using valid ID or accurate information.
- No consignor, seller, or seller's agent may bid on their own consigned goods.
- Employees of Woolsey Auction Company may bid at any auction if they wish to purchase an item.
- All items become the sole responsibility of the purchaser once the auctioneer confirms the winning bid; we are not responsible for lost or stolen items.
Loss of Bidding Privileges
- Failure to pay for an item, or to pick it up on time, will result in revocation of your bidding privileges. Privileges may be restored one time only, by paying for the item — or covering the lost revenue from the unsold item — and placing a credit card on permanent file for automatic charges on future purchases. Repeated tardiness or nonpayment will result in permanent loss of bidding privileges.
Delinquent Accounts
- A bidder who has not paid for, or removed, items from the auction site is responsible for the cost of storage, trucking, resale, any deficiency balance, collection fees, and legal fees incurred in recouping the loss. Unpaid invoices must be paid within 24 hours of the auction's close; after that period, bidding privileges will be permanently revoked.
Reserves
- All items Woolsey Auction Company agrees to sell are subject to a reserve, as permitted under Colorado state auction law.
Documents
- Buyers and sellers must fully complete all required documents — for example, death certificates, letters of authority, creditor liens, and UCC filings when purchasing vehicles, firearms, and similar items.
- All firearm buyers must complete an ATF Form 4473 and pass a background check. Out-of-state buyers must have firearms shipped to a Federal Firearms License (FFL) dealer.
Compliance With the Terms of Sale
- If payment in full is not received within the announced time frame, the Auction Company may, in addition to any other legal remedy, retain all monies received as a deposit or otherwise, as liquidated damages.
- Woolsey Auction Company operates in accordance with Colorado statutes and the Colorado Code of Regulations (see rule).
Warranties
Everything is sold “AS IS / WHERE IS,” with no express, implied, or other warranties, representations, or guarantees. All sales are final.
Conditions of Items Sold
- All information is believed accurate, but the Auction Company is not responsible for the correctness, authenticity, or condition of any lot, and makes no warranty regarding it. No allowance will be made, and no sale set aside, for a cataloging error or an unnoted imperfection. No deduction will be made for damaged items, as all goods on public exhibition are sold “as is” and without recourse. Woolsey Auction Company requires all buyers to preview items and form their own opinion of condition.
Bidder Registration
Bidders must be at least 18 years old and must register for the auction with current, complete, and accurate information for identification purposes. The Auctioneer does not sell or rent this information, and uses email lists only to notify customers about upcoming online and live auctions; customers who wish to be removed from the list may contact our office.
Bidders are responsible for the security of their bidder number/username and password, and for all bids placed under their assigned ID. Notify the Auctioneer immediately if you believe your number or password has been compromised.
The Auctioneer reserves the right, at its sole discretion, to terminate a registration, deny any person permission to bid, reject any or all bids, and suspend or ban a bidder from bidding. Bidder registration is not transferable or assignable.
Online Bidding Information
Bidders acknowledge that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of the Auctioneer. We are not responsible for malfunctions in your system or internet connection, or for your email provider blocking delivery of our bid confirmations or outbid notifications.
